TERMS AND CONDITIONS FOR USE OF NDMA JOB ADVERTISING WEBSITE FACILITY.

 

‘NDMA’ ‘we’; ‘us’; and ‘our’; means North Devon Manufacturing Association

 

‘Candidate’; ‘You’ and ‘Your’ means any person using our site for job seeking purposes.

 

‘Recruiter’; ‘You’ and ‘Your’ means any person, company, organisation or firm which have direct job vacancies within their own organisation(s).

This job board is owned and operated by NDMA and is made available to you on the following terms and conditions. By using the site and the services available on it you are deemed to accept these terms and conditions and any additional terms and conditions which expressly apply to services and information provided by third parties.

The NDMA have included a job board for member companies to advertise job vacancies.

This facility is available solely for the use of companies advertising directly for positions within their own organisations.  

No recruitment agencies, employment agencies, consultancies or third party advertisers permitted.

 

Job Advertising

Job adverts go live after they have been authorised by an NDMA Administrator as being appropriate for publication.

If it is not possible to verify this from the information provided, we will contact you to request further information. This may delay the time it takes for jobs to go live.

Job vacancies remain live for 28 days after which they will expire. If you wish the post to continue after this time, you will need to resubmit the form.

Should you wish to remove a post before it expires, please contact NDMA via the website contact page.

 

Site Rules

 

For Recruiters

We have rules regarding the content and format of jobs posted onto the NDMA job board.

Their purpose is to ensure that users who search the site get results which are presented as clearly and informatively as possible. You agree that we may, at our discretion and without liability to you, remove from NDMA any advertisement which is posted in breach of these rules. The rules may change from time to time and you are advised to refer to them regularly.

 

The Rules are:

Job advertisements placed on the NDMA website must be for genuine vacancies only, and not for other products or services, either relating to or unrelated to recruitment including, but not limited to, affiliate schemes, pyramid selling schemes or any other so called ‘business opportunity’.

The job posted must exist in the town advertised, unless it is a franchise opportunity (which must be stated in the description).

The job title should be specific and be the best description for the role. It must not include locations or salaries and should not be a slogan (e.g. Great Opportunity or Money To Be Made!).

The description of the role should mention the required skills as well as details describing the role.

Advertisements which discriminate (or appear to discriminate) on grounds of sex, race, age or disability are illegal and may result in proceedings being taken against both the advertiser and the publisher.

Advertisements are accepted by NDMA on the basis that the advertiser confirms that any requirement or qualification which may appear to discriminate illegally is fully compliant with any exemption available under the relevant legislation. Notwithstanding this confirmation, if we nonetheless believe that an advertisement may be discriminatory we may at our discretion remove it from NDMA without liability to you and we will inform you accordingly

The vacancy should accurately describe the role and not mislead the Candidate; sufficient detail should be included in order for the Candidate to understand the nature of the role and the basic requirements of the role. If a role requires a Candidate to work in multiple locations then the vacancy must state this; if the role is selling a product/service ‘door-to-door’ then the vacancy must state this; similarly, if the role is a commission only role then this must be stated on the vacancy.

URLs or email links (live or text only) are not permitted in the body copy of the job description page.

Responses to advertisements

You agree to deal fairly and professionally with individuals who may respond to an advertisement you have posted and not do anything which may bring NDMA into disrepute. You will indemnify us from and against any claim brought by an individual against NDMA arising from your breach of this obligation or any other of these terms and conditions.

We do not guarantee any response to your advertisement or that responses will be from individuals suitable for the job advertised. It is your responsibility to carry out such checks and procedures as are necessary to ensure that candidates are suitable for the job advertised and have the required qualifications and personal characteristics.

 

Equipment

It is your responsibility to ensure that you have the appropriate equipment and are connected to the appropriate services to enable you to post jobs to the NDMA’s website job board.

 

Content and links

If your advertisement links to another site you are responsible for maintaining the links and for the content of your advertisement and the linked site. We may remove from NDMA any advertisement which contains content or links to a site which, in our opinion, is defamatory, illegal or objectionable or will bring NDMA into disrepute. You will indemnify us from and against any claims or liability arising from content or links contained in your advertisements.

 

The NDMA job board facility acts as a venue only, and is not responsible for the content of job adverts from different employers.

 

Terms for Candidates

If a vacancy is of interest to you, please contact the hiring organisation concerned direct, quoting the reference ‘NDMA’. You will find appropriate contact details on the advertisements.

 

The NDMA job board acts a venue for organisations to advertise and promote job vacancies only.

If you apply for an advertised job you will apply directly to the organisation that has advertised the vacancy using the

You acknowledge and agree that You are solely responsible for the form, content and accuracy of any application you submit to employer’s job vacancies advertised using their direct link, and or contact details to submit your application or interest.

 

Job advertisements

Job advertisements contained on the site are uploaded directly by the prospective employers.

We accept no responsibility or liability for the contents of advertisements and expect candidates and prospective employers to carry out such verification procedures as are customary and prudent in the circumstances.

Services and information provided on the site by us and our third party suppliers are intended to assist in the job seeking or recruitment process. Neither we, nor our third-party suppliers can guarantee their suitability or prospects of success in any particular case. You should obtain independent verification before relying on information provided on the site in circumstances which may result in loss or damage.

 

For both Recruiters and Candidates

 

Material submitted by You

You agree not to submit any material:

that is false, misleading, defamatory, discriminatory, threatening, offensive, abusive, likely to cause someone anxiety or distress, encourages violence or racial or religious hatred, blasphemous, pornographic, in breach of confidence, in breach of privacy; or

that infringes any intellectual property rights, such as copyright and trade marks. This means generally that you must own the rights in everything you submit or must obtain permission from the rights owner to submit the material; or

which is technically harmful (including, without limitation, computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software or harmful data); or

which encourages or teaches conduct that is a criminal offence, gives rise to civil liability, or is otherwise unlawful.

We are not obliged to use material submitted by you and we may remove from the Site and the Services any of the material submitted by you at our sole discretion.

We will not be responsible, or liable to any third party, for the content or accuracy of any materials submitted by you.

 

Service availability

We try to ensure continuous availability of the site and all the services available on it but accept no responsibility for the consequences of interruptions or delays, however caused. We may, additionally, alter the design and specification of the site at any time.
